미등록 외국인노동자와 외국인 산업연수생에 대한 차별대우가 만연한 현실을 개혁하기 위해서는 현행 제도의 보완으로는 불충분하므로 별도의 입법이 필수적이다. 따라서 「외국인노동자의 고용 및 관리에 관한 법률」에는 외국인노동자의 고용과 관리에 관한 내용과 절차를 규정하고, 노동자로서의 권리를 보장하고 그들의 인권 침해를 예방하기 위한 제도적 장치 등이 포함되어야 한다. 법률은 규제와 보호라는 양날을 지닌 칼과 같다. 또한 경과 규정을 두어, 현행 산업연수생 사용업체에 상대하여는 기존 연수계약기간 만료 시까지 산업연수생의 고용을 인정하여야 할 것이다.
